Interlocutory order on expert fees and reports held non-separately appealable; appeal inadmissible.
Legislator summary
AI generatedThe court dismissed the appeal (recurs) as inadmissible, thereby upholding the challenged interlocutory order of June 10, 2010, which had required expert reports to be redone, ordered the expert to return 1500 lei to the appellant, and imposed on the appellant the obligation to pay 3000 lei in expert fees. The dispute arose from a civil appeal in which the expert challenged an intermediary ruling regarding expert fees and report corrections. The decisive legal basis was that, under Article 299(2) read with Article 282(2) of the Romanian Civil Procedure Code, an interlocutory order that does not interrupt the course of proceedings can only be appealed together with the final judgment on the merits, not separately; since the order did not interrupt proceedings, the separate appeal was inadmissible. The decision is final (irrevocabilă).
