The High Court of Cassation and Justice admitted the statute of limitations exception and dismissed the defendant's appeal on cassation as late-filed, thereby leaving in force the appellate decision that upheld the first-instance judgment. The underlying dispute was a commercial action for the recovery of unpaid social security contributions, unemployment fund fees, and indirect site organization costs, which the trial court had awarded to the local council claimant against the defendant company, along with interest and litigation costs. The cassation court determined that the defendant, having received the appellate decision on July 23, 2001, failed to meet the strict 15-day deadline by filing the appeal on August 13, 2001. Relying on Article 301 of the Civil Procedure Code, which establishes an imperative time limit, and Article 103(1) of the same code, which prescribes the sanction of forfeiture for non-compliance, the court ruled that the lateness of the filing barred the cassation appeal from substantive review.

Asupra recursului de față;

103 alin.
