The Supreme Court of Romania upheld the prior appellate decision by declaring the plaintiff's appeal perished, thereby leaving in force the Court of Appeal’s dismissal of the defendant’s appeal and the first-instance court’s cancellation of the underlying suit for insufficient stamping. The case involved a commercial dispute where a claimant sought the return of specific industrial machinery or its monetary equivalent from a debtor, but the initial action was annulled due to procedural non-compliance with stamp duty requirements. Applying Article 248 of the Code of Civil Procedure, the court held that the claim was perished by right because it had remained in neglect for more than six months, a period that commenced when the appeal proceedings were suspended pursuant to Article 242(2) of the Code of Civil Procedure due to the unjustified absence of the parties at a scheduled hearing.
