The High Court of Cassation and Justice declared the appeal filed by the Chamber of Financial Auditors of Romania null and void, thereby upholding the lower court's partial judgment in favor of the claimant. The appellate court reasoned that the appellant failed to file a statement of grounds for appeal within the 15-day statutory deadline, and, finding no ex officio public-order grounds, applied Article 306(1) of the Code of Civil Procedure to annul the appeal. The underlying dispute concerned a challenge to the Chamber's refusal to grant the claimant membership and an authorization for independent practice as a financial auditor, with the court of first instance having ordered the Chamber to issue the necessary documents while rejecting the claim for annulment of the refusal decision.

Asupra recursului de față;
