Nullity of appeal for lack of mandatory motivation under Art. 306 of the Code of Civil Procedure
Legislator summary
AI generatedThe Supreme Court declared the appeal null and void, thereby leaving the lower court’s decision intact and final. The dispute concerned a procedural challenge where a commercial entity sought to recuse a specific judge and was subsequently fined for filing an unfounded recusal motion. The decisive legal basis for the outcome was Article 306 of the Code of Civil Procedure, which mandates the nullity of an appeal that is not properly motivated within the statutory deadline, a defect the appellant failed to cure.

1081 alin. (1) pct. 1 lit. b) C. proc. civ. a aplicat intimatei SC R.C. SA o amendă judiciară de 700 lei.
Împotriva acestei încheieri a declarat recurs SC R.C. SA, fără însă să-l motiveze.
Potrivit art. 306 alin.
