The High Court of Cassation and Justice (Criminal Section) rejected as unfounded the petitioner's request to transfer the case (strămutare) from the Cluj Court of Appeal to another court, obliging the petitioner to pay 100 lei in judicial costs to the state; the decision is final. The petitioner, a defendant in a criminal case at the Cluj Court of Appeal, sought the transfer claiming legitimate suspicion of bias—alleging she could not study the file, was tried in her absence due to late summons, and that the judges' objectivity might be compromised because the injured parties were employees of the Cluj Financial Guard. The High Court held that the invoked grounds did not fall within the exhaustive scope of Article 55 of the Romanian Criminal Procedure Code (as amended by Law No. 356/2006), which lists the conditions for case transfer, and that mere unsubstantiated assertions about the magistrates' impartiality based on the victims' professional status did not constitute a serious reason for transfer; the court also noted that the Ministry of Justice confirmed that all conditions for fair justice were ensured at the Cluj Court of Appeal.

Asupra cererii de strămutare de față;

Văzând și dispozițiile art. 192 alin. (2) C. proc. pen.;
