Peremption of cassation appeal due to six-month procedural inactivity following suspension
Legislator summary
AI generatedThe High Court of Cassation and Justice declared the appellant’s cassation appeal expired, thereby rendering the lower court’s decision to annul the initial appeal as untimely for lack of stamp final and irrevocable. The dispute involved a commercial company that had appealed a first-instance civil judgment, which was subsequently annulled by the appellate court for failure to pay the required procedural stamp; the appellant then lodged a cassation appeal against this annulment but failed to request the case be placed back on the roll after the proceedings were suspended for the parties’ absence. Relying on Article 248 of the Civil Procedure Code, which stipulates that judicial requests expire as a matter of law if they remain dormant for six months due to the fault of the parties, the court determined that the appeal had become legally ineffective because the six-month period had elapsed without any action from the litigants.

Asupra recursului de față;
I.” S.R.L. Tg.Mureș împotriva sentinței civile nr.73/2000 a Tribunalului Arad.
