Commercial appeal peremption due to one-year procedural inactivity during suspension
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the appeal as perempted by operation of law, leaving the prior appellate decision in force. The dispute involved a commercial matter where the appellant’s appeal against a first-instance commercial decision had been suspended on November 18, 2009, and subsequently remained in a state of inactivity for over one year without any procedural acts being performed by the parties. Applying Articles 248 and 252 of the Code of Civil Procedure, the court determined that in commercial matters, any claim remains subject to automatic peremption if it stays in idleness for six months due to the fault of the parties; although the period in this case exceeded the statutory six-month threshold, the specific application of the peremption rules resulted in the extinction of the appeal. The decision was rendered as irrevocable.
