The court denied as inadmissible the convicted petitioner’s request for extraordinary appeal (recurs în anulare) against a 2003 appellate conviction, because the legal provision authorizing that remedy (art. 411 of the former Criminal Procedure Code) had been repealed before the petition was filed; the court ordered the petitioner to pay 50 lei in judicial costs to the state, and the ruling is final. The dispute involved a prisoner’s challenge to his conviction, alleging a mistaken factual assessment, filed under the abolished remedy.

Asupra cererii de față;

1 pct. 5 din Legea nr. 576/2004.

Așa fiind, Înalta Curte, în baza art. 38515 pct.
