Nullity of appeal for failure to submit reasoned grounds in commercial litigation
Legislator summary
AI generatedThe Supreme Court of Romania declared the appeal filed by the plaintiff null and void, thereby leaving the lower court's decision on the merits fully in force, and ordered the appellant to pay the respondent a reduced attorney’s fee of 500 lei as litigation costs. The case involved a procedural challenge where the plaintiff appealed a chamber decision from the Commercial Section of the Bucharest Court of Appeal that had previously dismissed a request to refer a constitutional unconstitutionality exception to the Constitutional Court as inadmissible; however, the appellant failed to submit any reasoned grounds for the appeal at the highest level. The decisive legal basis for the outcome was Article 306 of the Code of Civil Procedure, which provides for the nullity of an appeal not accompanied by valid motives when no public order grounds exist that could be raised ex officio, alongside Article 274(3) of the same code, which authorized the reduction of the requested attorney’s fees in proportion to the subject matter of the dispute and the work performed.

Împotriva menționatei încheieri a declarat recurs recurenta SC S.B.
274 alin. (3) C. proc. civ.
