Commercial contract breach; appeal annulled as untimely stamped, upholding judgment for price, damages, and costs
Legislator summary
AI generatedThe High Court of Cassation and Justice annulled the appellant's appeal as untimely stamped, thereby leaving in force the lower court decision that had previously dismissed the defendant's appeal for lack of proper stamping; consequently, the initial judgment ordering the defendant to pay the plaintiff a sum of 16.469.122 lei in price, 2.453.899 lei in damages, and 1.608.842 lei in litigation costs remains operative. The dispute originated from a commercial contract where the plaintiff alleged the defendant failed to fulfill contractual obligations, leading to a first-instance victory for the plaintiff which was subsequently upheld after the defendant's intermediate appeal was rejected on procedural grounds. The decisive legal basis for the final outcome was the strict requirement under Article 20(3) of Law No. 146/1997, which mandates the automatic annulment of any appeal if the required judicial stamp fees are not paid by the first hearing date, a condition the appellant failed to meet despite being given notice to cure the defect.

R. A. I. S.R.L. București în contradictoriu cu pârâta S.C. E. S.R.L.
Împotriva acestei hotărâri, a declarat recurs pârâta S.C. E. S.R.L. Tulcea.
