The High Court of Cassation and Justice (First Civil Section) declared the defendant municipality's appeal (recurs) against a 2004 appellate court decision to be perimated (extinguished by lapse of time) because the case had remained dormant for over one year due to the parties' inactivity after the appeal was suspended in October 2005. The court ordered the dismissal of the appeal as perimated, rendering the prior appellate decision irrevocable. The case involved a civil dispute in which the municipality had challenged an appellate ruling, and the court based its decision on Articles 248(1), 252, and 312(1) of the Romanian Civil Procedure Code, which provide that any procedural claim or appeal is perimated by law if left unresolved for one year due to the party's fault, with no interruption or suspension of the peremption period and no special legal provision preserving the claim. Since the parties failed to appear or take any procedural steps, the court found the statutory conditions for peremption satisfied and declared the appeal extinguished, leaving the earlier judgment final and binding.

Asupra cauzei de față, constată următoarele;
