Lapsed appeal leaves restitution denial standing; claimant's challenge perimé.
Legislator summary
AI generatedThe court declared the claimant’s appeal (recurs) against the appellate decision of the Court of Appeal Galati as perimé (lapsed) and thereby left the prior decision in force, resulting in the respondent prevailing. The underlying dispute concerned the claimant’s challenge to an administrative order under Law No. 10/2001, seeking restitution of a half-share of property based on that law or one-third under common law, after the court of appeal had rejected the appeal on the merits. The Supreme Court, applying Article 248(1) and Article 252(1) of the Civil Procedure Code, held that the proceeding had remained inactive for over one year due to the claimant’s failure to pursue it, and therefore the appeal was perimé as a matter of law; the decision was final and irrevocable.
