Perishing of appeal due to six-month procedural inactivity in commercial litigation
Legislator summary
AI generatedThe High Court of Cassation and Justice ruled that the appeal declared by the defendant against the Commercial Court of Appeal’s judgment was perished, leaving the appellate decision dismissing the defendant’s appeal against the first-instance sentence irrevocably in force. The dispute concerned a commercial case where the proceedings had been suspended and subsequently remained inactive for more than six months due to the parties' fault, despite prior procedural steps including a suspension for unjustified absence and a subsequent resumption. Relying on Articles 248(1) and (3) of the Code of Civil Procedure regarding the perishing of appeals due to prolonged inactivity attributable to the parties, and Article 312 for the procedural form, the court ordered the extinction of the appeal rather than a substantive review of the merits.
