The High Court of Cassation and Justice (Criminal Section) ordered that the case be forwarded to the Prosecutor's Office attached to the High Court of Cassation and Justice for investigation, without ruling on the merits, thereby not granting the petitioner's request to prosecute the respondent. The petitioner had filed a direct criminal complaint with the High Court against a senator, alleging abuse of office against individuals' interests and concealment of fraud in the European parliamentary elections in Romania. The Court found that, although under Article 29(1)(a) of the Romanian Criminal Procedure Code it has first-instance jurisdiction over crimes committed by senators and deputies, under Articles 209(3) and (4) of the same Code, criminal prosecution in such cases must mandatorily be conducted by the Prosecutor's Office attached to the High Court. Since the complaint was incorrectly addressed directly to the Court rather than to the competent prosecutorial body, the Court, applying Article 222(7) of the Criminal Procedure Code, transferred the case accordingly, with appeal available.
