The High Court of Cassation and Justice dismissed the direct jurisdiction over the case and ordered the referral of the criminal complaint to the Public Prosecution Service attached to the High Court of Cassation and Justice, effectively siding with the procedural requirement that such initial filings must be addressed to the competent prosecution authority rather than a court. The dispute arose from a convicted inmate’s complaint against the Director General of the National Penitentiary Administration, alleging abuse in office detrimental to persons' interests after the defendant was transferred from a civilian hospital to a penitentiary hospital in inappropriate conditions following surgery. The court ruled that a criminal complaint constitutes a means of initiating criminal proceedings to be submitted to the prosecution authority, not the judiciary, and therefore the court’s censure power was limited to reviewing a prosecutor’s decision not to prosecute or not to send the case to trial, which did not apply here as no such decision existed. Relying on Article 222(7) in relation to Article 29(1)(d) of the Code of Criminal Procedure, the court held it was not legally vested with the authority to directly censor or adjudicate the complaint and thus referred it to the competent public prosecutor.

Asupra cauzei penale de față;

222 alin. (7) C. proc. pen. rap. la art. 29 pct. 1 lit. d) C. proc. pen., instanța neputând fi legal investită cu cenzurarea directă a unei asemenea plângeri.
