Transfer of criminal complaint against Court of Appeals judge to competent prosecution based on jurisdictional incompetence
Legislator summary
AI generatedThe High Court of Cassation and Justice ordered the transfer of the petition to the High Court Prosecutor’s Office for competent resolution, effectively dismissing the case from the judicial docket. The dispute involved a criminal complaint filed by an individual against a Court of Appeals judge, alleging that the magistrate committed an offense, which was mistakenly addressed to the court rather than the investigative authority. Applying Article 222(7) of the Code of Criminal Procedure regarding the redirection of complaints to the competent authority, the Court determined that jurisdiction for investigating crimes committed by Court of Appeals judges lies exclusively with the High Court Prosecutor’s Office pursuant to Articles 209(3)-(4) and 29(1)(f) of the Code of Criminal Procedure, necessitating the administrative re-rout of the file.
