The High Court of Cassation and Justice (ICCJ) dismissed the complaint for lack of jurisdiction and referred the case to the Bucharest Sector 1 Court, effectively ruling that the prosecutor's exception of incompetence was well-founded. The dispute concerned a challenge against an order issued by the National Anti-Corruption Directorate (DNA) of the ICCI Public Prosecutor's Office, which the petitioner argued should be adjudicated by the ICCJ given the identity of the issuing body. The court determined that jurisdiction over such complaints is not automatically vested in the ICCJ based solely on the prosecutor's office, but rather lies with the court that would have had jurisdiction to try the underlying case in the first instance according to subject matter and personal quality; as the ICCJ lacked such jurisdiction, it applied the procedural rule for incorrectly directed complaints and remanded the matter to the territorially and subject-matter competent lower court.
