Jurisdictional misdirection of criminal complaint to court instead of prosecutor for offenses within High Court competence
Legislator summary
AI generatedThe High Court of Cassation and Justice ordered the transfer of a criminal complaint to the Prosecutor's Office of the High Court, ruling that the complaint was incorrectly filed directly with the court; consequently, the individual petitioner did not prevail in having the complaint adjudicated by the bench. The dispute concerned a procedural jurisdictional error where the petitioner had lodged a complaint against multiple public officials, including directors of a state information and protection service, for offenses falling under the specific competence of the High Court under Article 29(1)(d) of the Code of Criminal Procedure. The decisive legal basis was Article 222(7) of the Code of Criminal Procedure, applied in conjunction with Article 209(3), which mandates that for crimes within the High Court's first-instance jurisdiction, the preliminary investigation must be conducted exclusively by the prosecutor, thereby requiring such complaints to be directed to the Prosecutor's Office rather than the judicial bench.

Astfel fiind, potrivit art. 222 alin.
