Challenger to non-initiation of criminal prosecution referred to Public Prosecutor due to erroneous jurisdiction and missing pre-litigation step.
Legislator summary
AI generatedThe High Court of Cassation and Justice ordered the referral of the complainant's filing to the Public Prosecutor's Office near the High Court for competent resolution, effectively dismissing the court's jurisdiction over the matter. The dispute arose when a complainant challenged a prosecutor's resolution refusing to initiate criminal proceedings against a magistrate for alleged offenses under Articles 246 and 264 of the Penal Code; however, the court determined that the mandatory pre-litigation step under Article 278(3) of the Code of Criminal Procedure had not been completed, and that the complaint was erroneously addressed to the judiciary rather than the prosecutorial authority. Relying on Article 278/1(13) and Article 278 of the Code of Criminal Procedure, the court found the filing misdirected and lacked the requisite procedural preconditions, thereby mandating its transmission to the Public Prosecutor's Office for proper handling.

278 C. proc. pen.
