The High Court of Cassation and Justice ruled that the appeal (recurs) declared by the defendant company against the Court of Appeal's decision was perempted, leaving the first-instance eviction judgment and the appellate court's procedural ruling in force. The dispute concerned an eviction case where the appellate court had annulled the defendant's appeal for lack of stamp duty, leading to a suspension of the appeal hearing in February 2009 due to the unjustified absence of the parties; no further procedural acts were taken by the parties thereafter. Relying on Articles 248 and 252 of the Civil Procedure Code, the court determined that the one-year statutory period for peremption in commercial matters (extended to six months) had elapsed due to the parties' fault in leaving the case inactive for more than six months without just cause, thereby effecting the peremption of the appeal ex officio.

Asupra recursului de față;

242 alin. (1) pct.

248 alin. (1), art. 249 și art. 250 C. proc. civ., Înalta Curte urmează a constata perimată cererea de recurs.
