Commercial appeal perished for procedural inactivity, rendering prior judgment final
Legislator summary
AI generatedThe High Court of Cassation and Justice declared the appeal filed by the defendants, a municipal administration and its mayor, to be perished, thereby rendering the prior appellate court's decision final and irrevocable. The dispute originated in commercial litigation where the defendants appealed a lower court judgment, but the proceedings were suspended and subsequently remained dormant for six months due to the parties' failure to perform any procedural acts. Applying Articles 242(2), 248, and 252 of the Code of Civil Procedure, the court held that the statutory conditions for peremption in commercial matters were met, resulting in the automatic extinction of the appeal without a substantive review of the merits.
