The High Court of Cassation and Justice (Administrative Disputes Section) dismissed as time-barred the motion for annulment (contestație în anulare) filed by the Ministry of Administration and Interior, as successor to the former Ministry of Public Administration, against Decision No. 3851 of 11 December 2002, which had previously allowed a claimant's appeal, quashed the lower court judgment, and remanded the case for retrial. The court determined that under Article 319(2), second sentence of the Civil Procedure Code, a motion for annulment against irrevocable judgments not subject to forced execution must be filed within 15 days from the date the movant learned of the decision. Since the ministry had been lawfully summoned for the 11 December 2002 hearing at which the decision was rendered, and presented no evidence of circumstances beyond its control preventing earlier knowledge of the ruling, the motion filed on 10 April 2003 exceeded the statutory deadline. Consequently, the court rejected the motion solely on grounds of tardiness, without addressing the merits of the alleged improper service.

Asupra contestației în anulare de față;

Astfel, potrivit prevederilor art. 319 alin. 2 fraza a II – a C.proc.civ.
