Appeal for failure to prosecute declared perimated; appellate ruling left intact.
Legislator summary
AI generatedThe court found the appeal (recurs) filed by the defendant against the civil decision of the Court of Appeal to be perimated (lapsed) and declared it irrevocably extinguished, thereby leaving the lower court's decision intact and in force. The dispute arose from a commercial/civil case in which the defendant challenged an appellate ruling, but the proceedings at the High Court were suspended on 19 November 2008 under Article 242(1)(2) of the Romanian Code of Civil Procedure and remained idle for over a year due to the parties' inaction. The court applied Articles 248 and 252 of the Code of Civil Procedure, holding that any claim lapses by operation of law if it remains unresolved for one year in civil matters (or six months in commercial matters) through the fault of the parties, and that such lapse may be raised ex officio. Since the statutory conditions were met and no procedural steps were taken, the appeal was deemed perimated, making the appealed decision final.
