The court admitted the claimant's appeal (recurs), quashed the appellate decision (no. 166/A of 8 July 2008 of the Bucharest Court of Appeal, 9th civil section) and remanded the case to the same court for re-hearing of the appeal; the claimant prevailed on the procedural issue, while the underlying merits (the action seeking to restrict a person's free movement for up to 3 years in Switzerland) were not decided here. The dispute arose from the trial court's dismissal of the action as unfounded, after which the claimant's appeal was annulled as unstamped for failure to pay the judicial stamp fee under art. 11(2) of Law no. 146/1997. The High Court found the appeal was wrongly annulled because the claimant had proven, via documents filed in the appeal phase, that it paid the stamp fee and judicial stamp by payment order no. 2415 of 8 July 2008; the annulment was therefore reversed under art. 304 point 9, art. 312(1) and art. 313 of the Civil Procedure Code, with the case remanded for a fresh consideration of the appeal on the merits.

Asupra recursului de față;

312 alin. (1) și art. 313 C. proc. civ.
