Prisoner's electricity cut challenge remanded to Giurgiu Court on delegated-judge jurisdiction
Legislator summary
AI generatedThe court granted the appeal, vacated the lower court's decision, and remanded the case to the Giurgiu Court (Judecătoria Giurgiu) for competent adjudication, thereby ruling in favor of the appellant (a detained person) and against the prior dismissal of his claim. The dispute arose from an administrative action in which the appellant challenged the prison administration's decision to cut electricity, which allegedly prevented him from watching a television broadcast on 10 December 2006, asserting a violation of his right to information; the Court of Appeal Bucharest had dismissed the action as inadmissible for failure to file a prior administrative request. Decisively, the court held that under Article 38 of Law No. 275/2006 on the execution of sentences, restrictions on the rights of convicted persons are permissible only within constitutional and legal limits, and any measure concerning the exercise of such rights taken by the prison administration must be challenged by a complaint to the delegated judge for enforcement of custodial sentences within 10 days, making the delegated judge—attached to the Giurgiu Court—the proper forum, which warranted remand.

Asupra recursului de față;
