Legislator summary

AI generated

The court annulled the appeal (recurs) as void because it was not motivated within the legal deadline, leaving the lower court’s judgment in force; the appellant had challenged a decision to place them in public custody (an administrative detention measure ordered by a prosecutor’s resolution), and the appellate court found no grounds of public order to consider ex officio. The case arose from an administrative-law challenge to the detention measure, and the decisive legal basis was Articles 301, 303, and 306(1) of the Romanian Code of Civil Procedure, which require the appeal to be filed and motivated within the statutory time limits, with failure to do so resulting in nullity unless public-order grounds are present.

Asupra recursului de față;
