The High Court of Cassation and Justice admitted the defendant’s appeal, quashed the appellate decision, and remanded the case to the same court (Bucharest Court of Appeal) for retrial, thereby invalidating the prior dismissal of the defendant’s request to revise his criminal conviction. The defendant had sought revision under Article 394(a) of the Romanian Criminal Procedure Code, which the trial court and appellate court had rejected as unfounded. The High Court found that the appellate decision’s minutes were signed by only one judge, creating uncertainty as to whether the panel was lawfully composed of two judges as required, thus triggering the cassation ground under Article 3859(1)(3) of the Criminal Procedure Code (breach of procedural provisions when the court was not properly constituted); it ordered the retrial, with the appointed defense counsel’s fee paid from the Ministry of Justice’s fund, and the decision was final.

Asupra recursului de față;
