Rejection of criminal revision petition alleging judicial misconduct as non-compliant with statutory revision grounds
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as unfounded the cassation appeal filed by a convicted individual against the appellate decision upholding the rejection of a request for revision of his final criminal conviction, thereby affirming the lower courts' rulings and ordering the appellant to pay 140 lei in judicial costs, including an advance for official defense from the Ministry of Justice. The dispute concerned a post-conviction petition to revise a prison sentence, wherein the appellant alleged that judges and prosecutors had committed a criminal offense during the original investigation of the case; however, the court found that this allegation did not satisfy the exhaustive statutory conditions required for the extraordinary remedy of revision. The decision was grounded in the strict interpretation of Article 394 of the Code of Criminal Procedure, which limits grounds for revision, and Article 385^15 paragraph 1 letter b) of the same code, leading to the conclusion that the claimed reasons were legally insufficient to warrant the reopening of the case.

Împotriva acestei hotărâri a declarat recurs revizuientul.
38515 pct. 1 lit. b) C. proc. pen.
Se vor aplica și dispozițiile art. 192 C. proc. pen.
