Pension authority's appeal rejected; child born to political refugees during displacement entitled to benefits under GO 105/1999
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the pension authority’s appeal as unfounded, thereby upholding the Court of Appeal’s decision that annulled the challenged administrative decision and recognized the claimant’s status as a beneficiary under Government Ordinance No. 105/1999, as approved by Law No. 189/2000, with the administrative order being set aside and the claimant’s entitlement affirmed. The dispute arose over the claimant’s application, opposed by the county pension authority, for recognition as a beneficiary of the law concerning persons persecuted for political reasons; the authority argued that children born after their parents’ displacement could not qualify because the claimant lacked legal capacity at the date of the persecution. The court rejected this argument, holding that a child born while the parents were refugees acquires the legal status of the parents from birth, and thus the claimant, born during the parents’ refugee period, was entitled to the benefits from birth until the specified end date. The decision is grounded in the interpretation of Law No. 189/2000 and procedural law under Article 312 of the Civil Procedure Code.

Asupra recursului de față;
