The Romanian High Court of Cassation and Justice rejected the claimant's appeal as unfounded, thereby upholding the Court of Appeal Craiova's decision to dismiss the action, so the dismissal remains in force. The claimant, a private individual, sued the Romanian State and various public authorities (Ministry of Finance, Prosecutor's Office, Ministry of Justice, and a prefecture) seeking a declaratory judgment that they violated the European Convention on Human Rights—specifically the right to an effective remedy, the right to a fair trial, the protection of property, and the right to private and family life—alleging that state institutions failed to conduct investigations against judges who allegedly entered irrevocable judgments infringing his property rights. The lower court had dismissed the claim, reasoning that courts cannot censure other judicial decisions, which may only be challenged through legally provided appeals. The appellate court affirmed, holding that the lower court had properly examined the claim and evidence, that no conduct by the defendants violated the claimant's property rights, and that judicial decisions cannot be reviewed by administrative authorities or through such a direct declaratory action, being subject only to statutory appeal remedies under Articles 6 and 13 of the Convention and Article 1 of Protocol No. 1.

Asupra recursului de față;

Împotriva acestei hotărâri a declarat recurs, reclamantul R.G., susținând că:

- hotărârea nu cuprinde motivele pe care se sprijină;

- instanța, interpretând greșit actul juridic dedus judecății, actul de proprietate nr. 146 din 1 martie 1990, a schimbat natura și înțelesul lămurit al acestuia;

- hotărârea pronunțată a fost dată cu încălcarea și aplicarea greșită a legii, a Constituției României și a art. 481, 969, 1191, 1203, 1173, 1174, 1312, 1328, 1334 și 1900 C. civ.;
