Annulment of appeal for non-payment of judicial stamp tax despite denied free legal aid
Legislator summary
AI generatedThe High Court of Cassation and Justice annulled the appellant's appeal as unfranked (missing the required court fee), thereby leaving in force the lower court's decision to annul the original lawsuit for the same defect. The dispute concerned an administrative claim against the Ministry of Public Prosecution for unjustified refusal to handle a request regarding a legally recognized right; both the first-instance action and the subsequent appeal were rejected because the appellant failed to pay the mandatory judicial stamp despite his application for free legal aid being denied as unfounded. The decisive legal basis was the strict requirement for advance payment of judicial taxes under Article 9 of Emergency Government Ordinance No. 32/1995 and Article 20 of Law No. 146/1995, which mandates the annulment of proceedings that do not comply with this financial obligation.

Asupra recursului de față;
