The High Court of Cassation and Justice dismissed the appeal of the County Pension House, confirming that the appellant (a claimant seeking refugee status benefits) prevailed in the administrative lawsuit. The Court upheld the lower instance's decision, which annulled the administrative authority's 2005 refusal and ordered it to recognize the claimant's status as a refugee for the period between 1941 and 1945, thereby granting the monetary rights provided by Law No. 189/2000. The dispute concerned the existence of ethnic persecution, where the claimant alleged that her family was forced to flee their domicile due to threats by legionaries and discriminatory refusal of medical care on the basis of speaking the Hungarian language. The decisive legal basis was the determination that forced displacement from a domicile due to ethnic threats and hostile official attitudes constitutes ethnic persecution under the relevant statutory framework, with the appeal rejected as unfounded pursuant to Article 312 of the Code of Civil Procedure.

Asupra recursului de față;
