Suspension of appeal proceedings pending resolution of a motion for completion: Exclusion of appellate court competence to assess timeliness
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the civil appeal as unfounded, thereby upholding the lower appellate court's suspension order and confirming that the appellant lost the procedural challenge. The dispute arose when the appellant opposed a first-instance civil judgment on appeal, during which the appellate court suspended proceedings pursuant to Article 244(1) of the Code of Civil Procedure pending the resolution of a motion for amendment and completion of the initial judgment filed by the opposing party. The appellant argued that the appellate court erred by suspending the case without verifying whether the completion motion was filed within the statutory deadline, alleging that it was time-barred. The court held that the appellate court lacked both the competence and the obligation to assess the timeliness of the completion request, as that determination was exclusively within the jurisdiction of the first-instance court, which had already resolved the matter subsequently, thereby extinguishing the grounds for suspension.

Asupra recursului civil de față;
