Nullity of cassation appeal for lack of legal representative’s signature under Art. 302(d) Civil Procedure Code
Legislator summary
AI generatedThe High Court of Cassation and Justice declared the appeal in cassation filed by the debtor company null and void, thereby leaving the appellate court's decision in force which had admitted the creditor's request for the enforcement of a seizure. The case involved a procedural dispute where the creditor initially sought permission for compulsory execution against the debtor, which was rejected by the first instance but subsequently granted by the appellate court via a decision changing the initial outcome. The debtor's opposition was submitted as a cassation appeal containing formal defects. The decisive legal basis for the judgment was the nullity of the appeal due to its failure to include the signature of the legal representative or the company stamp, violating the mandatory requirements for a cassation petition under Article 302(d) of the Code of Civil Procedure.

302 lit. d) C. proc. civ., declară nul recursul SC E.B.A.O. SRL București.
