The High Court of Cassation and Justice removed the case from its docket and remanded it to the Bucharest Court of Appeal, ordering the appellate court to solve the dispute; no merits were decided at this level. The underlying civil and commercial litigation involved an insurance/reinsurance company's request for approval to take possession of a vehicle, which had been rejected by the District Court and upheld on appeal by the Court of Appeal. This procedural decision was based on Article 2(3) of Law No. 219/2005, which mandated that pending appeals falling under the jurisdiction of appellate courts following the law's entry into force be transferred back to the respective appellate courts for resolution.
