The Supreme Court of Cassation and Justice declined to hear the claimant foundation's appeal on the merits, instead referring it to the Timișoara Court of Appeal. The underlying dispute concerned the claimant's action to declare the State's property right over a building in Arad as invalidly constituted and to annul a 2000 sale-purchase contract for non-residential space, which had been dismissed by the first-instance court and partially upheld on appeal. The High Court found that under the procedural rules in force as amended by O.U.G. no. 138/2000 and Legea no. 219/2005, appeals against judgments rendered by tribunals in appellate capacity fall within the jurisdiction of courts of appeal, not the High Court. Consequently, pursuant to art. II alin. (3) of Legea no. 219/2005, the Court ordered the transfer of the appeal to the Timișoara Court of Appeal for competent adjudication.

Asupra recursului civil de față;

Împotriva acestor hotărâri a declarat recurs reclamanta fundația C. București.

Având în vedere prevederile art. 2, pct. I, pct. 1 din O.U.G. nr. 138/2000, modificate, ulterior, prin art. I, pct.

I, pct. 4 din O.U.G. nr. 138/2000, modificate, ulterior, prin art. I, pct.
