The Supreme Court of Cassation and Justice ordered the transfer of the appeal to the Cluj Court of Appeal for competent resolution, based on the transitional provisions of Law No. 219/2005, leaving the underlying civil dispute regarding the partial compensation of judicial costs pending in that lower instance. The case involved an appeal against a decision by the Cluj Court of Appeal, which had modified a first-instance judgment by partially offsetting the claimant's advanced court costs against those of an intervener and ordering the intervener to pay the remaining balance of 5,705,750 lei. The decision was driven by the jurisdictional restructuring enacted in Law No. 219/2005, specifically Article II(3), which mandated that appeals against tribunal decisions pending on the docket at the law's entry into force on July 14, 2005, be referred to the respective Court of Appeal, as it had assumed the role of the appellate court for tribunal judgments following the amendments to the Code of Civil Procedure.
