Authenticity of notarial signatures in power of attorney and heir status determining refusal to initiate prosecution for intellectual forgery
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the petitioner’s appeal as unfounded, upholding the Court of Appeal’s decision that rejected the private complaint against a notary public, thereby confirming the prosecutor’s resolution not to initiate criminal proceedings and ordering the petitioner to pay 60 lei in judicial costs. The dispute centered on an allegation of intellectual forgery under Article 289 of the Criminal Code, where the petitioner claimed the notary authenticated a power of attorney containing a signature that was not genuine and accepted identification documents from a party who lacked the legal status of heir. The court found that the lower instances were correct because pre-trial investigations conclusively established that the signature on the power of attorney and other notarial instruments belonged to the daughter of the former property owners, who was present at the time of authentication, thus negating the alleged criminal act and validating the refusal to prosecute. </think> The High Court of Cassation and Justice dismissed the petitioner’s appeal as unfounded, upholding the Court of Appeal’s decision that rejected the private complaint against a notary public, thereby confirming the prosecutor’s resolution not to initiate criminal proceedings and ordering the petitioner to pay 60 lei in judicial costs.
