Criminal complaint against magistrate for insult and defamation remitted to prosecutors; appeal rejected with costs.
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the petitioner's appeal and upheld the lower court's decision, which had removed the case from its docket and referred the petitioner's complaint to the Prosecutor's Office attached to the Bucharest Court of Appeal. The dispute involved a criminal complaint filed by the petitioner against a magistrate for the offenses of insult and defamation. The Court ruled that the appeal was unfounded because, under the applicable procedural rules, for offenses requiring a prior complaint—such as insult and defamation—when the complaint targets a judge, it must be addressed to the competent prosecution body, which in this instance is the Prosecutor's Office attached to the Bucharest Court of Appeal. The petitioner was ordered to pay judicial costs to the state.

I.C.C.J., secția penală, decizia nr. 744 din 3 februarie 2006
279 alin. (2) lit. c) C. proc. pen.
Împotriva hotărârii menționate a declarat recurs petentul fără să-l motiveze.
Examinând din oficiu cauza potrivit art. 3856 alin.
Or potrivit art. 209 alin. (3) C. proc. pen., raportat la art. 281 alin.
