The High Court of Cassation and Justice, Criminal Division, dismissed one defendant's appeal as inadmissible and accepted the other defendant's withdrawal of their appeal, thereby upholding the prior appellate court's decision to maintain pretrial detention for both individuals. The case concerned the admissibility of a cassation appeal filed by two defendants against an appellate ruling that extended their preventive detention, where the defendants argued the appellate court's decision should be reviewable. The Court held that under Article 141(1) of the Code of Criminal Procedure, an order issued during appellate proceedings to maintain pretrial detention cannot be separately challenged by appeal, rendering the first defendant's appeal inadmissible; for the second defendant, the Court accepted the withdrawal of the appeal under Articles 3854 and 369 of the Code of Criminal Procedure and ordered the payment of state judicial costs.

I.C.C.J., secția penală, decizia nr. 1530 din 8 martie 2006
