Lack of standing to appeal criminal detention order regarding other co-defendants
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed as inadmissible the appeals filed by two defendants against the Court of Appeal of Craiova's order upholding their preventive detention and rejecting recusation claims against the judges of the Olt County Court. The dispute concerned the procedural validity of the appeals, with the appellants invoking a procedural defect in the lower court's decision; however, the material facts established that the challenged decision pertained to different co-accused individuals, not the appellants themselves, who had separately appealed a different order concerning their own detention status. Relying on the principle that only parties directly affected by a specific judicial act possess standing to appeal, the court applied the procedural code provisions restricting the right to appeal to those enumerated in the relevant statutes concerning the affected parties, thereby finding the appellants lacked the legal interest necessary to challenge the order. Consequently, the lower court's decision regarding the other defendants' detention and recusation remained in force, and the appellants were ordered to pay court fees.
