Enforcement challenge over gas debt: failure to prove payment discharge under Civil Code Article 1169
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the appellant's appeal as unfounded, thereby upholding the lower court's rejection of the challenge to forced execution and leaving the original judgment in force. The dispute concerned a commercial debt for gas supply, where the debtor company contested the enforcement of a claim amounting to approximately 1,971 U.S. dollars by arguing it had already paid the final invoice via a payment slip. Relying on the standard of proof under Article 1169 of the Civil Code, the Court found that the appellant failed to provide sufficient evidence to substantiate its defense of payment, consequently rejecting the appeal under Article 304(9) of the Code of Civil Procedure and confirming the validity of the lower instance's application of the law.

304 pct.
