The High Court of Cassation and Justice declared the defendant's appeal inadmissible due to nullity, leaving intact the lower court's order that the defendant pay the claimant approximately 83.6 million lei in price, 310.1 million lei in late payment penalties, and related litigation costs. The dispute involved a commercial claim for payment of a contract price and associated penalties, where the appellate court had reversed and amended the first-instance judgment to include the penalty award. The decisive legal basis was the non-compliance with the statutory requirements for appeals under the Civil Procedure Code; the defendant failed to properly structure and develop the grounds of illegality as required by Article 3021(1)(c) and Articles 304(1) and 304(2), and no public order grounds existed to justify cassation or modification, resulting in the automatic nullity of the appeal petition.

art. 3021 alin. (1) lit. c) C. proc. civ.

Imposes the mandatory requirement to include grounds of illegality in the appeal request, whose violation led to the sanction of nullity.

art. 304 alin. (2) C. proc. civ.

Referenced to confirm the absence of public order grounds that would have justified an exceptional review despite the procedural defect.
