**Final Operative Outcome:** The High Court of Cassation and Justice issued a procedural decision dismissing the appeals on the merits by declaring itself incompetent, thereby remanding the case to the Pitești Court of Appeal for a decision on jurisdiction and substance; consequently, the first-instance judgment granting the claimants' rights and the appeal court's dismissal of the defendants' appeals remain in force pending the referred jurisdictional determination. **Dispute and Material Facts:** The case involved a civil action for the re-establishment of ownership and peaceful possession of a villa and associated land, where the original claimant and co-owners sought to evict municipal authorities, private individuals, and other entities occupying the property; the defendants filed cross-appeals challenging the lower courts' rulings that affirmed the claimants' title. **Decisive Legal Basis:** The decision was grounded in Article II, paragraphs (3) and (4) of Law No. 219/2005 (approving OUG No. 138/2000), which mandated that for disputes with a value below a specific threshold, appeals pending before the High Court at the time of the law's application must be referred back to the respective Courts of Appeal for competent resolution.
