The High Court of Cassation and Justice (Civil Section I) declined to adjudicate the merits and ordered the case transferred to the Alba Iulia Court of Appeal for competent resolution, ruling that the appeal (recurs) falls under the appellate court's jurisdiction. The dispute originated with a plaintiff's action seeking annulment of a sale-purchase contract and correction of the land register entry, which was dismissed by the Sibiu First Instance Court and affirmed by the Alba Iulia Court of Appeal; the plaintiff then filed a further appeal with the High Court. Legally, the High Court held that under art. II para. (3) of Law No. 219/2005, read with art. 2 point 2 of the Civil Procedure Code as amended by that law, jurisdiction over the pending appeal lies with the court of appeal, not the High Court, and accordingly transferred the case. The transfer decision is final and irrevocable.
