The High Court of Cassation and Justice declined jurisdiction and remanded the case to the Ploiești Court of Appeal as the competent court for resolution. The dispute originated from a civil suit where a public hospital claimed 100 million lei for necessary expenses from a defendant, who filed a reconventional claim and the local city council intervened in support of the plaintiff; the decision on appeal had reversed the trial court's judgment. The recusal of the High Court was grounded solely in Article II(3) of Law No. 219/2005, which prescribed that the appellate court, rather than the cassation court, was the competent instance to hear the appeal against the lower appellate decision.

Asupra recursului de față;
