The High Court of Cassation and Justice dismissed the appellant’s appeal by declaring it null and void, thereby upholding the lower courts’ refusal to establish a right of passage. The dispute involved a claim by a landowner against multiple defendants for the establishment of a servitude of way of access (right of passage) over their properties, alleging that his plot was landlocked with no access to a communal road; the initial court dismissed the action as inadmissible against one defendant due to res judicata and unfounded against the others because the plaintiff refused to undergo a specialized expert examination, and the appellate court affirmed this decision. The decisive legal basis for the final decision was the procedural requirement that an appeal in cassation must contain specific grounds of illegality as mandated by Articles 3021(c) and 304 of the Civil Procedure Code; because the appellant failed to articulate these grounds and no public order issues existed for the court to raise ex officio, the court declared the appeal null pursuant to Article 306(1) of the Civil Procedure Code.

Asupra recursului de față;
