The Supreme Court of Romania ordered the declination of jurisdiction, referring the case to the Pitești Court of Appeal for the adjudication of the appeal, thereby leaving the underlying first-instance judgment on its validity pending until the competent appellate court reviews it. The dispute involved an action to exit indivision regarding the inheritance of two deceased individuals, where the appellant challenged the first-instance civil decision. The decisive legal basis was Article 3, paragraph 2, subsection (1) of the Code of Civil Procedure, as amended by Emergency Government Ordinance No. 65/2004, which vested jurisdiction for appeals in matters of this nature with the Courts of Appeal, not the Supreme Court, pursuant to Article 2, point 3 of Law No. 493/2004.
