Easement of passage denied due to existing direct public road access; cassation dismissed
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the appellant’s appeal, rendering the appeal court’s decision final and thereby reinstating the dismissal of the claim; the plaintiff prevailed in the first instance by obtaining an easement of passage, but the defendant prevailed in the second and third instances, leaving the defendant’s land free of any servitude. The case involved a civil dispute where the plaintiff, a landowner, sought to establish a right of way (servitude of passage) across the defendant’s adjacent property to access a public road, asserting that a shorter route existed exclusively over the defendant’s land. The court found the appeal unfounded because a technical expert report confirmed the plaintiff already had direct, unimpeded access to the public road from their own property, rendering the requested easement unnecessary and non-compliant with the legal requirements for such servitudes. The decision was based on Articles 616 and 618 of the Civil Code, which stipulate that an easement of necessity may only be established for a landlocked property with no other exit, and that if a passage is permitted, the route causing the least damage to the neighbor must be chosen; since the plaintiff was not landlocked, the lower courts correctly rejected the action.

312 alin. (1) C. proc. civ.
